The Electronic cigarette industry has been holding its breath for a while now. With legal action outstanding that could have banned the devices from the market, many suppliers have been waiting to increase technology investnment until the road forward for the industry was clear.

The road had been muddied by dis-information from parties worried by how this new industry and product was  going to severely impact their profits.

After a two year campaign by the FDA to intervene in the electronic cigarette industry and move the devices to regulation as ‘drug devices’ effectively getting them banned from the marketplace, it finally announced on Monday its decision to stop fighting repeated court decisions in favour of the industry and regulate the marketing of e-cigs under the Tobacco Control Act.

On its website Monday the FDA stated “The U.S. Court of Appeals for the D.C. Circuit, in Sottera, Inc. v. Food & Drug Administration, 627 F.3d 891 (D.C. Cir. 2010), recently issued a decision with regard to e-cigarettes and other products “made or derived from tobacco” and the jurisdictional line that should be drawn between “tobacco products” and “drugs,” “devices,” and combination products,  as those terms are defined in the FD&C Act.  The court held that e-cigarettes and other products made or derived from tobacco can be regulated as  “tobacco products” under the Act and are not drugs/devices unless they are marketed for therapeutic purposes. The government has decided not to seek further review of this decision, and FDA will comply with the jurisdictional lines established by Sottera.”

The decision should now open the market to ’serious’ suppliers and eliminate the fly by nights who offer teen enticing flavours and health claims in their marketing.

Q. What was your smoking habit before the electronic cigarette?

I started smoking when I was about eighteen. I put it down to pier pressure, a new school, trying to fit in etc. Since I started I gradually increased the amount I smoked until I was on about 50 a day.

Q.  So how did you come across the electronic cigarette and…tell us what happened.

Well it was my wife who first discovered it. She was introduced to it by a neighbor who had heard that she was going in for dental surgery. It was fascinating…. but my initial reaction was that it wouldn’t replace my tobacco cigarettes but could come in handy when we were out, in a bar or restaurant. So I really tried it for that purpose.

Q. So What Changed?

Well, we were moving into a condo at the time…where you couldn’t smoke…well you had to go out onto this tiny balcony. It was a pain and when it rained etc..you get the picture.

So I started using the electronic cigarette more and more and soon, after about three days I started to enjoy it more than the tobacco. In fact I can honestly say that after three days smoking my Regal I started to wonder why I ever smoked tobacco. It was like smoking the ‘uncut’ stuff! It was cleaner, smoother…just totally more enjoyable.

You know about two months down the road we had returned to Spain and I ran out of cartridges and had to buy a pack of cigarettes…wow…who would have thought..it was like sticking my tongue in the ashtray.. I guess you de-sensitize to all the crud in a cigarette over time so you just dont taste it..that’s probably why it took a couple of days to get used to the taste of the electronic cig. It takes that amount of time just to get ride of the build up in your mouth of the tobacco crud.

Q. So it wasn’t the health issues that made you change?

No, but of course they are a consideration..you know…every smoker knows..knows that its killing them slowly. But it doesn’t make us quit.  So to say I moved to electronic because of self interest would be a half  lie. At the back of my brain was something telling me…hoping that this would be easy to do…that it would get me off tobacco…which would save my life. Lets be clear here though. I understand that there are no health benefits to an electronic cigarette. The benefit is allowing me to continue to smoke and feed both the addiction to nicotine and the habit of smoking, which i enjoy…without having to use tobacco as the delivery system…that’s the benefit.

I honestly didn’t think it would be possible…but it works…worked. I look forward to my e-cig with my first cup of tea in the morning. I get it out at the table after dinner…even at my parents! something i would never have done with a cigarette.

Q. What about the press reports and the recent court case with the FDA that say it is unsafe?

Look, I am an intelligent guy. I did my homework. I read the studies and the FDA report and put all the facts together before I started. It is one of the reasons I got involved with Inlife LLC. The rest of the cheap chinese copycats out there online need to either get on board with verification or be taken out of the market. There is no point in moving from one thing that will kill you to smoking something else that you later find out has god know what in it. I remember the chinese milk and the toy thing that happened in China…everyone does. But what I am smoking now..that is verified independently…it  has no known cancer causing agents in it…..for me its got to be the single most important breakthrough in public health that has occurred since….innoculation.

Of course you are fighting the two biggest lobby groups probably on the planet…the drug companies that make millions from patches and gum that are only 4% effective…not surprising that they are worried. i mean, something comes along that actually works…where do think there profits are going? yea, right down the toilet with their gum!

You know what I would like to see. i would like to see Obama get involved and stand up if he is the man we thought we all voted for and say…I am not going to let the lobbyists win this fight…c’mon, its will have a bigger saving than anything put forward in the health bill. It will save more lives in terms of harm reduction than any patch, gum or TV advert will ever achieve. I know it needs some regulation but a lot of that regulation is in place in terms of verification already…if inlife can do it…make anyone who wants to sell them do it as well.

We already have Congressmen & Senators using them. This is one fight that needs to be won on the facts and not the interests of the drug & tobacco companies.

Q. You feel strongly about the issue?

Yes i do. So much that I got involved with company that is doing most to get the message out to the people that need it.

We smokers are a funny breed.  We hate being told what’s good for us.  We will back ourselves into a corner and fight like a wildcat. I think it comes from being lectured to,  by everyone down to our own parents about ‘what you are doing to yourself’.

I am just hoping that as a smoker, through and through, I can get the message across to other smokers that this is a great thing. It is better than smoking tobacco…as I said…cleaner, smoother..just more enjoyable….and dont forget cheaper as well!….. and you dont have to give up any of the things you love about smoking to stop smoking the brand that kills you…i.e. tobacco.

Thats good, I like that…just change from the brand that kills you to a brand that wont! I might use that in a banner!
